The Auction Organizer represents both the Client’s and the Bidders’ interests while ensuring fair competition.
The Bidder and Auction Buyer acknowledge that no claims regarding the quality or condition of the assets may be made after the auction ends. To allow Bidders and Auction Buyers to familiarize themselves with the assets, the auction items can be inspected at the location and time specified in the Auction Information before the auction. The assets are auctioned in their observed condition, which may differ from the images or descriptions in the Auction Information. The Auction Organizer assumes no responsibility for hidden defects or perceived deficiencies not detected during the inspection.
The Bidder and Auction Buyer acknowledge that they must arrange asset collection directly with the Client. The Auction Buyer must request asset handover directly from the Client. The Auction Organizer holds no liability for the availability, quality, or condition of the assets. Any complaints or claims regarding the assets must be addressed to the Client.
b) The Auction Organizer provides the necessary IT infrastructure for conducting the online auction. However, if a technical issue beyond its control occurs during the auction and is only reported afterward, this does not affect the auction’s outcome. If a Bidder detects an IT malfunction preventing them from bidding, they must immediately notify the Auction Organizer via phone or written online message. During the 5-minute bidding period, any detected IT or technical issues must be directly reported to the Auction Organizer. However, detecting such an issue does not warrant restarting the bid. Complaints about the IT system’s functionality after the auction closes will not be considered, and no re-auction will be conducted based on such claims.
Bidders are advised that participating in the online auction requires an internet connection with a minimum download speed of 128 kbit/s and an upload speed of 64 kbit/s.
Minimum Browser Requirements:
JavaScript execution must be enabled.
Any technical issues related to the online auction must be reported directly and exclusively to the Auction Organizer.
Bids cannot be withdrawn. The system requires confirmation for each bid, and once confirmed, the bid cannot be revoked. The maximum bid can be increased, but it can only be decreased to one bid increment above the current highest bid.
f) Extension of Closing Time: If a new bid is placed within the last 5 minutes of the auction’s scheduled end time, the auction will be automatically extended by another 5 minutes from the last bid. The auction will close once 5 minutes have passed without a higher bid.
7. Special Cases of Bidding
a) The Auction Organizer may apply a special form of online bidding, marked with a distinguishing label, where the highest bidder does not automatically become the owner of the item. In such cases, the auction does not end immediately after the last bid, but rather, the process concludes within one business day after the auction’s closure, pending approval from the Principal. The Principal reserves the right to confirm or reject the auction’s outcome. If approved within one business day, the online auction is finalized, and standard auction payment and ownership transfer rules apply. The Buyer is obligated to make payment upon auction closure, but the Principal’s obligation to sell is not immediate and is subject to final approval.
If the Principal does not approve the auction’s result within the one-business-day period, the auction is considered unsuccessful, and the items may be re-auctioned. The Principal exclusively retains this decision-making right, and all participants automatically accept these conditions by joining the auction. The Auction Organizer will highlight such auctions with a special notification, indicating “Conditional Sale.”
b) Another special form of conditional sale is the Group Auction, which is also explicitly marked. The Auction Organizer may auction related or complementary items as a group.
In a group auction, individual items are auctioned separately under the standard rules. However, for items also included in a group auction, individual bids remain conditional. Once the individual auctions close, a group auction begins from the highest winning bid amount of each item plus 10%. If no individual bid was placed on an item, its starting price in the group auction will be the initial listing price plus 10%.
The group can then be bid on under standard auction rules. If no valid bid is placed on the group, the highest individual bids are finalized. If a valid group bid is placed, the highest group bid takes precedence.
The start time of the group auction is not predetermined; it begins after the last individual auction closes and runs for one hour.
Payment Obligations, Delays, and Consequences:
Placing a bid in an online auction constitutes a binding payment obligation for the Bidder. Bidders acknowledge and accept this obligation by participating in the auction. If an auction successfully closes with a valid bid, the Bidder is legally liable for payment.
The winning bidder is the one who places the highest valid bid. If multiple bids of the same amount are placed, the earliest one takes precedence. The winning Bidder receives an email notification at the registered email address.
For specific high-value items, the Auction Organizer reserves the right to require Bidders to provide a bank guarantee before placing bids. Only those who submit the required bank statement in the specified form and manner may participate in such auctions. These conditions will be explicitly stated in the auction listing.
The winning Bidder (Buyer) must pay the full purchase price, including VAT and the auction fee, via bank transfer to the specified account within one business day of receiving the email notification. If payment is not received by the deadline, the Buyer will be considered in default, and legal action may be taken to recover the outstanding amount, including statutory interest. The Auction Organizer may also charge collection fees.
A Buyer who fails to fulfill the payment obligation within five days will be permanently banned from the auction system and will no longer be allowed to participate. The Auction Organizer may pursue legal action against non-paying Buyers in addition to banning them. Reinstatement is only possible after full payment, including late fees and administrative costs, and is subject to the Auction Organizer’s discretion.
If the auctioned items must be sold or removed within a shorter timeframe, the Auction Organizer may impose a shorter payment deadline. Legal proceedings may still commence after five days. The Buyer will receive an electronic notification regarding their exclusion from future auctions.
If the sale cannot proceed with the second-highest Bidder (due to withdrawal or lack of interest), the Auction Organizer reserves the right to re-auction the item.
If the Auction Organizer issues invoices directly to the Buyer, it does not assume responsibility for the existence, quality, or condition of the items. These remain the responsibility of the Principal, and the Auction Organizer acts solely as an intermediary in the transfer process.
Obligations Regarding Shipping, Delays, and Consequences
Upon full payment of the purchase price, the Auction Buyer is required to remove the asset within the specified deadline following the issuance of the Shipping Authorization. Failure to do so will be subject to the rules governing unauthorized possession. The dismantling, loading, and transportation of machinery and equipment may only commence after the payment obligation has been fulfilled and the Shipping Authorization has been received. The dismantling, removal, and all associated costs are the sole responsibility of the Auction Buyer.
The Auction Organizer assumes no liability for any accidents occurring during the auction, inspection, dismantling, or transportation. All participants inspect, dismantle, and transport assets solely at their own risk. The operation of machinery and equipment on-site is strictly prohibited. Violation of this prohibition results in full liability for damages.
All visitors to the auction are fully liable for any damages they cause to human life, health, buildings, or any other assets. The Auction Organizer disclaims any liability for accidents resulting from the condition of the machinery and equipment.
The Principal reserves the right to withdraw any item listed for auction before the auction s conclusion. The Auction Organizer will inform bidders of any such withdrawals but assumes no liability for these decisions. Should the Principal withdraw the entire product list from the online auction before its conclusion, the Auction Organizer will notify bidders, and the auction will be deemed unsuccessful. The Auction Organizer accepts no liability for such withdrawals, as they remain the Principal’s sole responsibility.
The Auction Buyer must arrange the removal of the purchased item directly with the Principal. If the Auction Buyer fails to remove the asset within the specified deadline, neither the Auction Organizer nor the Principal is obligated to store or safeguard it. The Auction Organizer reserves the right to terminate the sales contract and re-sell the asset, in which case the Auction Buyer shall be liable for a penalty fee amounting to 25% of the purchase price. Additionally, a storage fee of HUF 1,000 per square meter per day will be charged for any delayed removal. The Auction Organizer reserves the right to adjust the storage fee based on storage conditions, incurred costs, and prevailing rates.
The Auction Buyer is responsible for all costs associated with re-selling the asset, any resulting sales losses, and all other costs incurred due to late removal. The Auction Organizer is only obligated to account for the proceeds if the asset has been successfully resold and payment has been received from the new buyer. The Auction Organizer bears no responsibility for damages that would not have occurred had the Auction Buyer removed the asset on time.
The Auction Buyer must fulfill their removal obligation within the specified shipping deadline upon receipt of the Shipping Authorization. Failure to do so does not exempt them from payment obligations, and the Auction Organizer reserves the right to sell the asset to another bidder following contract termination. The original defaulting Auction Buyer is responsible for all storage and security costs, as well as any costs arising from their disqualification as the winning bidder. If payment for these costs is not received, the Auction Organizer will initiate legal proceedings for collection without delay.
Any bidder participating on behalf of another party assumes full joint and several liability as a guarantor for the Auction Buyer’s payment obligations.
In the event that the Principal is unable to deliver the auctioned item at the time of pickup, the dispute must be resolved directly between the Auction Buyer and the Principal. The Auction Buyer must notify the Auction Organizer within three days if they are unable to collect the purchased item. The Auction Organizer assumes no liability for undelivered items; however, if the purchase price has not yet been transferred to the Principal, the Auction Organizer will refund it within ten business days. If the purchase price has already been transferred, the refund will only be processed upon repayment from the Principal. The Auction Organizer is not liable for claims related to non-delivery; any such claims must be pursued directly against the Principal. The Auction Organizer is also not responsible for refunds if the delay is caused by the Auction Buyer’s failure to notify them in a timely manner, particularly if the Principal is unable to refund the purchase price due to insolvency or liquidation.
If the purchased item is found to be in a worse condition than when inspected, damaged, or defective at the time of pickup, the same conditions apply. The Auction Buyer must provide proof of any deterioration, but the Auction Organizer assumes no liability beyond facilitating a refund in justified cases of contract termination. All other disputes must be settled between the Auction Buyer and the Principal.
Upon full payment of the purchase price, all risks and responsibilities related to the asset, including damage, loss, fire, water, natural disasters, theft, or burglary, transfer to the Auction Buyer. The Auction Buyer bears full financial responsibility for the asset and its components.
Participation in auctions is conditional upon acceptance of the terms set forth in this Auction Regulation.
If any modifications are made to this Auction Regulation, the Auction Organizer must immediately notify previously registered Auction Buyers. Continued participation in auctions requires acceptance of the updated regulations, which the Auction Buyer acknowledges as binding upon them.
